  1. 1. ELIGIBILITY

    • This Promotion is open to all Malaysian citizens, permanent residents of Malaysia or Malaysian residents (with valid student pass, employment pass, work permit, or long-term visit pass and with valid Malaysian mailing address) aged 18 years old and above.
    • All employees of Ferrero, its affiliates, subsidiaries, distributors, alliance partners, advertising, promotions and third-party agencies, and their relatives up to the second degree of consanguinity and affinity are disqualified from joining this Promotion.

    A total of 111 winners will be selected throughout this Promotion. The following Prizes have been allocated for this Promotion.

  1. 4. HOW TO JOIN AND RULES OF ENTRY

    1. Step 1: Purchase a minimum of RM 35 worth of any of the products specified in Section A3 from any of the stores listed in Section A in a single receipt. Each valid receipt entitles the participant to one (1) chance to play Ferrero Rocher’s “Golden Match” Game, which will determine the participant’s score and eligibility for the prizes described above. Participants may submit multiple receipts for multiple chances to play, provided that each entry complies with these Terms and Conditions.
      The following information must be printed/ indicated clearly on the receipt/proof of purchase:
      1. The name of the store where the products were purchased
      2. Date of purchase (purchases made before or after the Promotion period as specified in Section A will not be accepted)
      3. Quantity and description of the products purchased; and
      4. Receipt number

    2. Step 2: To participate, please visit www.ferrerorochermy.com and submit your entry between 01st January 2026 and 28th February 2026. Eligible purchases are defined as purchases made in a single receipt between 01st January 2026 and 28th February 2026
    3. Step 3: At the end of the Promotion, winners will be determined based on their final leaderboard rankings. Only participants whose receipts have been validated will have their scores reflected on the leaderboard. See Section B, Paragraph 5 below.
      1. The Grand Prize winner shall be the participant ranked number one (No. 01) on the leaderboard
      2. The Second Prize winners shall be the participants ranked from number two (No. 02) to number eleven (No. 11) on the leaderboard, for a total of ten (10) winners
      3. The Third Prize winners shall be the participants ranked from number twelve (No. 12) to number one hundred and twelve (No. 111) on the leaderboard, for a total of one hundred (100) winners
      4. In the event of a tie in scores among participants occupying any of the prize-winning positions on the leaderboard, the winner(s) shall be determined based on the earliest date and time at which the tied score was achieved, with priority given to the participant who achieved the score first. Should a tie still remain, Ferrero reserves the right to conduct a random draw among the tied participants to determine the winner(s).
      5. Ferrero reserves the right to determine the suitability of the entries at its sole and absolute discretion, and to disqualify any entries it determines to be incomplete, ineligible, or inappropriate for any reason.
      6. If any winner is subsequently discovered to be ineligible to participate in the Promotion or to receive a Prize, Ferrero reserves the right to (i) forfeit or withdraw the Prize at any time; or (ii) (where such Prize has been redeemed) claw-back the Prize or require the relevant participant to repay to or compensate Ferrero the value of the Prize at any time. No person shall be entitled to any payment or compensation from Ferrero should the Prize be forfeited or withdrawn, if the Prize is reclaimed by Ferrero, or if a winner is asked to repay or compensate Ferrero the value of the Prize for whatsoever reasons.
      7. Ferrero is not responsible for technical, hardware or software malfunctions, lost or unavailable network connections, undeliverable email, or failed, incorrect, inaccurate, incomplete, garbled or delayed electronic communications, telephone, telephone line or other telephone, electronic device or network related problems or errors, whether caused by the sender or by any of the equipment or programming associated with or utilized in this Promotion, or by any human error which may occur in the processing of the entries in this Promotion. If, in the opinion of Ferrero, there is any suspected or actual evidence of tampering with any portion of this Promotion, or if technical difficulties compromise the integrity of this Promotion, Ferrero reserves the right to terminate this Promotion and determine a winner using all eligible entries received as of the date of termination or to modify this Promotion in a manner deemed appropriate by Ferrero.

  2. 5. WINNER SELECTION

    1. Selection of winners will be done at the end of this Promotion.
    2. Winners will be selected via their leaderboard rankings as specified in Section B4.
    3. Each participant can only win 1 (one) Prize under this Promotion.
    4. The list of winners (their last names and the last 4 digits of their mobile phone numbers) will be announced on the date as specified in Section A3 via the website and via Ferrero Rocher Malaysia Facebook as specified in Section A3.
    5. The winners will be informed by way of email within 1 week from such date. In the email, the winners are required to acknowledge, complete and submit to Ferrero via email a digital quit claim form. Only upon submission of the quit claim form, the prizes will be sent out to the winner via Email / Registered Mail.
    6. If the winners cannot be contacted or fail to provide the required details within 1 (one) week from e-mail date, they will automatically be disqualified, and Ferrero reserves the right at its sole discretion to choose another winner.
    7. Winners shall be responsible for any (if any) additional costs, duties, taxes and/or other incidental expenses which may be incurred as a result of and/or related to the winners’ claiming and/or acceptance of the prize.
    8. No substitution or transfer of prize shall be permitted except at the option of Ferrero. Ferrero reserves the right to substitute a prize for equal value in place of advertised prizes that are unavailable.
    9. Acceptance of a prize constitutes permission to use the winner’s last name and/or likeness for advertising of the Promotion without further notice or compensation, unless prohibited by law.
    10. The outcome of the selection of winners is final and no correspondences will be entertained.
    11. Ferrero hereby expressly disclaims from making any warranty in respect of the functions, specifications, quality of the Prizes and is in no way liable for any loss, damage, costs or expense of any nature (if any) arising thereof. All claims relating to the Prizes (if any), including product warranty claims, shall be directed to the providers or suppliers of the Prizes.

  3. 6. OTHER LEGAL TERMS AND CONSIDERATIONS

    1. In consideration of participant's submission being reviewed and evaluated for this Promotion, each participant hereby grants to Ferrero a non-exclusive, perpetual, irrevocable, fully paid, universal license to use, copy, sublicense, transmit, distribute, publicly perform, publish, delete or display such submission, or any portion thereof, in any media now known or hereafter devised including, but not limited to, all forms of television and all forms of internet and wireless protocol without any further right of approval. Each participant authorizes Ferrero and/or its affiliates, partners and promotion agencies to utilize the submission submitted to Ferrero and to make derivative works from such material in any manner they see fit. Each participant agrees that the results and proceeds of such use shall become the property of Ferrero and/or its affiliates; and shall be freely assignable by Ferrero and/or its affiliates and that Ferrero and/or its affiliates shall have no obligations whatsoever to the participant. Each participant releases Ferrero and/or its affiliates, partners and promotion agencies, from any and all claims or liability (now known or hereafter arising), including but not limited to any claims for defense and/or indemnity, in connection therewith.
    2. By participating in this Promotion, participants agree to abide by and be bound by these terms and conditions of participation and the outcome of the selection of winners by Ferrero. Failure to comply with the said terms, conditions, rules, regulations, instructions or methods will result in a participant’s disqualification.
    3. All users shall hold Ferrero and/or its affiliates free and harmless from any liability in case an entry is found to have infringed upon any third party’s rights, including copyright, publication right, or any other intellectual property or proprietary right.
    4. In no event shall Ferrero and/or its affiliates be liable to the participants for any monetary amount greater than the value of the prizes due to the prize winner under the rules and regulations of this Promotion.
    5. Ferrero and/or its affiliates shall not be liable to the participants in contract, tort or negligence or otherwise for any loss, damage, costs or expense of any nature whatsoever incurred or suffered by the participant and which is of indirect or inconsequential nature, including without limitation any economic loss or other loss. By participating in this Promotion and accepting the Prizes, the participants and winners waive any and all claims of liability against Ferrero and/or its affiliates, its employees and agents, for any injuries, losses, or damages of any kind caused by any Prize or resulting from the acceptance, possession or use or misuse of the Prize, or which may occur from the conduct of, or participation in, the Promotion, or while preparing for, participating in, and/or traveling to and from any prize-related activity. Prizes will be awarded “as is” with no warranty or guarantee, either express or implied, by Ferrero. Ferrero does not guarantee any third party’s performance, nor does it guarantee any of the services or materials provided by any third party.
    6. Ferrero reserves the right to amend the terms and conditions of this Promotion, as well as to suspend, modify or cancel this Promotion at any time with no prior notice.

    1. By participating in this Promotion, participants agree and consent to allow his/ her personal data being collected, processed and used by Ferrero and/or its affiliates, partners and promotion agencies for the purpose of this Promotion and in accordance with the Personal Data Protection Act 2012 (“PDPA”) and Ferrero’s Privacy Policy which may be viewed at https://www.ferrerorochermy.com/privacy.aspx Participants also confirm that all data provided is true and accurate to the best of his/ her knowledge.
    2. Ferrero and/or its affiliates, subsidiaries, partners and promotion agencies will collect each participant’s personal information for the purpose of administering the Promotion, including notifying and verifying successful participants, and announcing their names and last 4 digits of their mobile phone numbers on the website specified in Section A3. Personal information may be disclosed to authorized third parties in administration of this Promotion on behalf of Ferrero and/or its affiliates, subsidiaries, partners and Promotion agencies.
    3. Participants also consent to photographs and videos being taken of them during their participation in the workshops, and to the publication of the photographs and videos for advertising, promotional and marketing purposes.
    4. Any information and/or personal data which the participant will provide, or which is otherwise gathered in the context of this Promotion, will be used by Ferrero and/or its affiliates, partners and promotion agencies in compliance with the applicable legislation. This means, in particular, that any Personal Data processing carried out by Ferrero and/or its affiliates, partners and promotion agencies will respect the principles of lawfulness, fairness, transparency, purpose limitation, storage limitation, data minimization, accuracy, integrity and confidentiality.

3. How long do we keep your personal data?

Ferrero will keep your personal data as long as necessary for achieving the purposes listed above. In particular:

  • Website usage data: for more information on the retention period of cookies or similar technologies used on this Website, please refer to the table in our Cookie Policy.
  • Marketing communications data: if you have subscribed to a newsletter or similar mailing list, your data will be kept as long as the newsletter remains active or up to 1 month after you decided to unsubscribe. 
  • Promotional activity data: If you participated in a promotional activity (e.g., online contest), your data will be kept for a period up to 3 years after the end of that activity to ensure that Ferrero has fulfilled all its obligations.
  • Account data: as a guest user, your account data is only processed until your order has been fulfilled or the requested service has been provided. As a registered user, your account data will be kept as long as you have an active account with us. If you do not use your account for a consecutive period of 5 years, we will notify you about our intention to delete your account. If you do not object within a month of this notification, your account information will be deleted. You may of course create a new account at any time.

Upon expiration of these retention periods, your personal data will be deleted or anonymized, except if it is still necessary for us to keep them to comply with a legal obligation (for example, information on purchase orders and invoices to comply with consumer law or tax law) or to protect or defend our interests (for example in the event of a claim). As such, we would recommend that a parent or guardian assists and guides any children under 18 who may intend to browse the Website or access the services provided by Ferrero. Children under 18 should not use Ferrero’s Website or services without supervision of a parent or guardian. In the event Ferrero learns that it has inadvertently collected personal data from a child under the age of 18, Ferrero will promptly delete such information.
